Overview

NextTouch respects the intellectual property rights of others and expects users of the Service to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA").

Filing a Notice of Infringement

If you believe content on NextTouch infringes your copyright, send a written notice to our designated agent, below, including:

1. A physical or electronic signature of the copyright owner or someone authorized to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it on the Service (e.g., the club/team it's in, and who posted it, if known)
4. Your contact information — address, telephone number, and email address
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

Notices that don't substantially comply with the above may not receive a response.

What Happens After a Valid Notice

We will remove or disable access to the identified content and notify the user who posted it. Because NextTouch's clubs and teams are private and invite-only, this typically means removing a specific video submission.

Counter-Notification

If you believe content you posted was removed in error, you may submit a counter-notice including:

1. Your physical or electronic signature
2. Identification of the removed content and where it appeared before removal
3. A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification
4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district), and that you'll accept service of process from the person who filed the original notice

If we receive a valid counter-notice, we may restore the content in 10–14 business days unless the original complainant files a court action seeking to restrain the user from the infringing activity.

Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
