Agreement to Terms

By creating an account or using the NextTouch platform, mobile app, or website (collectively, the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These Terms apply to all users, including coaches, players (and their parents/guardians), and club administrators.

Description of Service

NextTouch is a coaching platform that lets soccer clubs manage rosters and teams, coaches assign training plans and review player video submissions, and players submit videos and receive feedback. The Service includes team messaging, private coach feedback, and subscription billing for clubs.

Eligibility and Accounts

You must be at least 13 years old to create your own account. If you are under 13, a parent or guardian must create and manage an account on your behalf (a "parent-managed account"). You are responsible for keeping your login credentials confidential and for all activity under your account.

Joining a Club or Team

Clubs and teams on NextTouch are private. Joining a specific team requires an invite code from that team's coach; becoming a club co-administrator requires an invite code from an existing admin. Joining a club as a coach requires approval from that club's administrator. Only use an invite code given to you directly by someone affiliated with that club or team.

Acceptable Use

You agree not to:

• Upload content that is illegal, abusive, harassing, hateful, or sexually explicit, or that otherwise violates the rights of others
• Upload a video of another person without appropriate consent (or, if that person is a minor, without their parent or guardian's consent)
• Use the Service to bully, harass, or harm any other user
• Access another person's account, or share your own account credentials with someone else
• Attempt to reverse-engineer, scrape, or disrupt the Service, or bypass any access controls
• Use the Service for any purpose unrelated to athletic coaching and development

User Content

You retain ownership of any video, message, or other content you submit. By submitting content, you grant NextTouch a limited, non-exclusive license to store, process, and display it solely to operate the Service — for example, so your coach can view your submission, or a teammate can see a video you've marked public. You are solely responsible for the content you upload and for having the right to upload it.

Video submissions are limited to 30 seconds. You may mark a submission private (visible only to your coach) or public (visible to teammates too); club admins and coaches may view submissions as needed to run the club. A coach may separately mark one submission as an "Example" for the team to see.

Private Coach Feedback

A coach may leave written feedback on a specific submission. This feedback is private — visible only to that player (or their parent, for a parent-managed account) and the coaches/admins of that team, never to teammates.

Team Messaging

The Service includes team-wide chat channels and direct messages between individual users. Messages are visible only to their intended recipients (the team, or the other participant in a direct message). Please treat other users respectfully.

Reporting and Blocking

You may report content or a user you believe violates these Terms; we aim to review reports within 24 hours. You may block another user at any time. We reserve the right to remove content or suspend accounts that violate these Terms, with or without a report having been filed.

Subscriptions and Payments

Clubs subscribe to NextTouch on a monthly plan (Starter, Pro, or Club). Payment is processed by Stripe; by subscribing, you also agree to Stripe's terms of service. Subscriptions renew automatically each month unless cancelled before the renewal date.

You may cancel at any time from the club admin dashboard. Cancelling schedules the subscription to end at the close of the period you've already paid for — you keep full access until then, and are not charged again afterward. Refund requests are handled case-by-case; contact us within 7 days of a charge if you believe a refund is warranted.

If a payment fails or a subscription is cancelled, the club is suspended: members lose access, but all data and videos are kept for 60 days in case of reactivation. If not reactivated within that window, the club and all of its data — including videos, rosters, and any co-admin accounts created solely for that club — are permanently deleted.

Account and Data Deletion

You may request deletion of your account at any time by contacting us. This removes your login and profile entirely — you would need to sign up again from scratch to use the Service afterward.

Termination

We reserve the right to suspend or terminate your account, or a club's subscription and access, for violating these Terms, engaging in abusive behaviour, or failing to pay applicable fees.

Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee the Service will be uninterrupted or error-free, or that data will never be lost. NextTouch is a software tool — we are not responsible for the coaching advice, instruction, or judgment of any coach or club using the Service.

Limitation of Liability

To the maximum extent permitted by law, NextTouch is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you for any claim will not exceed the amount you (or your club) paid us in the 12 months before the claim arose.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which NextTouch operates, without regard to its conflict-of-laws principles.
